我国目前并未出台专门针对网络爬虫技术的法律标准,但在司法实际中,相干裁决已不足为奇,K 哥特设了“K哥爬虫普法”专栏,本栏目通过对实在案例的剖析,旨在进步宽广爬虫工程师的法律意识,通晓如何非法合规利用爬虫技术,警钟长鸣,做一个违法、护法、有准则的技术人员。 开篇引言“才者,德之资也;德者,才之帅也。”                    —— 宋·司马光《资治通鉴》 大家好,我是K哥。置信前段时间都有关注到,吴谢宇一案最终尘埃落定。除了其人神共愤的滔天罪行,他身上还有一个备受关注的点,北大学生&高学历。 读书到底读到什么样才算读的好呢,是为天地立心,为生民立命,为往圣继绝学,为万世开太平吗?这些事儿,每一件都太大太大。但咱们读书,承受教育,不求读到惊天动地,最起码是要能不断完善自我,进步三观的。否则学识越大,学历越高,却不干人事儿,专逮着违法乱纪的事儿干,那就是离谱他妈给离谱开门,离谱到家了哈。 案情回顾 言归正传,讲回咱们的爬虫普法栏目。本期给大家分享一个高学历犯罪团伙,爬取公民个人信息数据,守法贩卖,最终被一窝端的案例。 事件是这样的,涉案人员王某等6人是一批高级知识分子,有博士,有研究生,还有海归,他们本来任职于一家科技公司,过后的公司做的是ETC相干的业务。在2020年11月前后,这几人陆续辞职,打算本人下海经商,大展一番拳脚。 于是乎,他们在上海成立工作室正式守业。然而这做生意啊,真不是谁都能做得来的。 K哥向来感觉有两种人特地聪慧,一是能把生意做的很透彻的人,二是搞科学研究的人,但王某的团队,显然不在其列。 守业未半,我的项目进度缓慢,前景堪忧!为了求生存,王某等人就开始寻找一些副业机会。 也就是在这期间,王某发现了本人前公司的风控破绽,原来本人过后在前东家任产品经理时的管理员账号还没登记,他依然可能进后盾数据库查问客户资料。 贫贱险中求,恶向胆边生!王某等人心一横,挣米的欲望霸占了道德的洼地,他们决定开始干数据交易的生意!人员完备,指标明确,随即立项分工:王某提供账户和明码,寻找买家;陈某编写爬虫脚本,林某负责加密脚本并爬取数据;唐某治理服务器和寻找买家;刘某、郑某利用“暗网”公布销售信息。 而且为了“平安”,他们还采纳了加密货币来进行交易。(这也从侧面反映了这哥几个早就分明本人干的是守法的勾当,明知法而犯法!) 一顿操作下来,王某几人胜利爬取了9万余条公民个人信息,包含姓名、身份证号、手机号、车牌号、发动机号和车架号等敏感数据。 他们还贴心地把这些信息被整顿成Excel表格,存在硬盘外面,只待交付变现。 奈何天公不作美,王某团队的业务发展的相当不顺利。 一开始,他们想以15元/条的价格在“暗网”上发售这些数据,这算盘打得好啊,9万多条信息数据,全卖出去就是一百多万。 然而现实很饱满,而事实很骨感,市场基本不买他们的账,压根就卖不出去。没方法,只能提价,但提价后还是卖不出去。 那就持续提价! 如此周而复始几轮之后,王某团伙被市场环境狠狠的教育了一顿。 最终只有他们的骨干成员之一刘某,以8毛钱到3块钱不等的价格,卖了2000多条数据进来,胜利获利2000多元人民币。 几经折腾下来,他们看清了这生意是压根做不了一点,遂于2021年1月底遣散了团队,各奔东西。 一杯浊酒尽余欢,今宵别梦寒……但故事并没有到此结束,人总得为本人做过的事件买单,不是不报,时候未到。 同年5月,公安机关在网络巡逻中发现了王某团伙的立功痕迹,不久后便把该团伙成员全副捉拿归案,一网打尽。 案发后,王某等6人均认罪认罚。(说他们聪慧吧,人均高学历,可偏偏干的都是傻事,吃亏还没讨到一点儿好,真是读书读到狗肚里,爬虫爬到牢里去!) 12月份,浙江省台州市路桥区检察院受理此案。检察官指出,本案中的6名涉案人学历较高,包含重点大学的在读博士研究生、硕士研究生及海归留学生。 他们的行为涉嫌进犯公民个人信息罪,法定刑为3年以上7年以下有期徒刑并处罚金。 鉴于此,经法院公开开庭审理后,当庭驳回检察机关量刑倡议,以进犯公民个人信息罪一审判处王某等6人有期徒刑3年,缓刑3年至4年不等,并各处罚金3000元。 同时法院反对检察院提起的刑事附带民事公益诉讼请求,裁决6人抵偿公益侵害赔偿金2000元。相干法条 ●《中华人民共和国刑法》第二百五十三条之一 【进犯公民个人信息罪】违反国家有关规定,向别人发售或者提供公民个人信息,情节严重的,处三年以下有期徒刑或者拘役,并处或者单处罚金;情节特地重大的,处三年以上七年以下有期徒刑,并处罚金。 ●《中华人民共和国民法典》第一百一十一条 自然人的个人信息受法律爱护。任何组织或者集体须要获取别人个人信息的,该当依法获得并确保信息安全,不得非法收集、应用、加工、传输别人个人信息,不得非法交易、提供或者公开别人个人信息。 ●《中华人民共和国个人信息保护法》第七十条 集体信息处理者违反本法规定解决个人信息,侵害泛滥集体的权利的,人民检察院、法律规定的消费者组织和由国家网信部门确定的组织能够依法向人民法院提起诉讼。 案件后续 为了贯彻落实“少捕慎诉慎押”刑事司法政策,22年8月,路桥区检察院就本案是否实用缓刑组织召开公开听证会。 该听证会上,其中该团伙成员之一的唐某,原是某重点大学在读博士研究生,他懊悔不已,粗浅检讨:“我很悔恨,没有意识到严重后果……心愿检察官能给我一次机会。”最终通过听证员评议,认为6名立功嫌疑人相干行为未产生较大的社会危害,没有前科,一致同意检察机关提出实用缓刑的量刑倡议。 还有个小插曲,也是22年8月份的时候,公安机关在立案侦查另一起涉毁坏计算机信息零碎罪案件时,软件鉴定陷入困局,遂邀请唐某团队参加破解。他们仅花了四天工夫就胜利破解涉案黑产软件,为软件鉴定获得冲破,把他们的能力用对了中央。 K言K语 其实K哥置信,这个团伙的成员,都不是大奸大恶之徒,但十年寒窗苦读,一朝爬虫被捕,只能说是咎由自取,怪不得任何人。但人生路漫漫,心愿他们可能多多检查,当前正确地应用本人学到的常识本事,造福社会。对于他们的法律意识淡薄,道德底线较低,我的倡议是多看看K哥的【爬虫普法专栏】。而对于他们的自作聪明,认为又是暗网又是加密货币就不会被逮,K哥只有四个大字,邪不压正!
